ICO considering complaint over Dentsu data breach as employees prepare legal action

The fallout from the Dentsu data breach continues to grow, with the UK’s data regulator (the ICO) reportedly considering a complaint about the incident. According to Campaign, more than 150 current and former employees are also preparing legal action over the way their personal information was allegedly exposed. 

For anyone caught up in the breach, this is an important moment. Regulatory scrutiny often uncovers new details about what happened, who was affected, and whether more could (or should) have been done to protect people’s data.  

What’s happened so far?

Dentsu suffered a major cyber incident earlier this year, which reportedly exposed sensitive employee information.

Questions remain over how much data was taken, how long systems were vulnerable, and whether all affected individuals have been notified. 
What’s more, while Dentsu’s investigation initially focused on employee data, later reports suggested that some client and customer information was also affected. This includes passenger information from train operator LNER.  

For many people, the lack of clarity is just as worrying as the breach itself. A data breach can create very real risks for the people whose details were exposed, from identity theft and fraud to long-term anxiety about who has access to your personal information. 

When the ICO steps in, it signals that concerns are being taken seriously. An investigation can: 

  • Force an organisation to provide clearer information
  • Establish whether security practices were adequate
  • Determine whether data protection laws were breached 
  • Lead to enforcement action or fines
  • Support future claims for compensation 

But an ICO investigation is only part of the picture. Individuals also have the right to seek compensation if a company failed to protect their data. 

Reports of a growing legal action suggests many feel they haven’t received the transparency or support they deserve. If the case proceeds, claimants are likely to argue that Dentsu failed in its duty to keep staff data safe and that the breach has caused distress, financial risk or measurable harm. This type of group action is becoming increasingly common, and it’s often the only route that ensures large organisations are held accountable. 

If you worked for Dentsu and think your personal information may have been compromised, it’s worth taking a few steps: 

  • Check whether you’ve received an official notification. Companies must tell you if your data was involved. 
  • Monitor your bank accounts. Breach victims are often targeted months later. 
  • Change passwords and enable two-factor authentication, especially if you reused old work credentials. 
  • Keep hold of all emails and letters from Dentsu, they may be important evidence later.
